PODMÍNKY POSKYTOVÁNÍ KOUČINKOVÝCH SLUŽEB

V RÁMCI KAMPANĚ KOUČINK PRO LOONO

(dále jen „Podmínky“)

A. Definice pojmů

  1. Poskytovatelem služby se rozumí koučka Jana Honková, sídlem na Výstavní 34, Brno 603 00, IČO: 76517772, www.janahonkova.com.

  2. Službou se rozumí individuální koučink (ve formátu kouč a 1 osoba – koučovaný) poskytnutý dle profesních standardů a v souladu s etickým kodexem Mezinárodní federace koučů (dále jen „ICF“, International Coach Federation), který je dostupný na www.coachingfederation.org.

  3. Dárcem se rozumí fyzická nebo právnická osoba, jež poskytne dar spolku Loono, z.s., IČO 02905639, skrze platformu www.donio.cz/loono v hodnotě min. 2000 Kč a zaškrtne na platformě políčko: „Chci za svůj příspěvek odměnu: online koučink“.

  4. Koučovaným se rozumí fyzická osoba, která se bude osobně účastnit koučinkového sezení. Tato osoba se může lišit od Dárce.

  5. Kampaň Koučink pro Loono je limitovanou nabídkou Poskytovatele, která spočívá v poskytnutí Služby individuálního koučinku Dárci odměnou za jeho dar při splnění těchto Podmínek. Samotné poskytnutí Služby může proběhnout i po ukončení kampaně; nárok Dárce může vzniknout pouze v době trvání kampaně.

  6. Doba trvání Kampaně Koučink pro Loono je omezena na 3.2. - 28.2.2021. Poskytovatel si vyhrazuje výhradní právo tuto kampaň jednostranně prodloužit anebo předčasně ukončit. V momentě, kdy platforma www.donio.cz/loono přestane nabízet možnost získat za dar odměnu v podobě koučinku, má se za tato kampaň za ukončenou.

 

B. Vymezení Služby a omezení počtu sezení na osobu

  1. Tyto Podmínky upravují poskytování Služby individuálního koučinku Poskytovatelem Dárci odměnou za jeho dar v hodnotě min. 2000 Kč skrze platformu www.donio.cz/loono v rámci Kampaně Koučink pro Loono.

  2. Zarezervováním sezení u Poskytovatele skrze platformu www.calendly.com Dárce souhlasí s těmito Podmínkami. Instrukce pro rezervaci a link Dárce obdrží od Loono, z.s. po uhrazení daru.

  3. Za každých darovaných 2000 Kč má Dárce při splnění těchto Podmínek nárok na 1 koučinkové sezení; maximální počet sezení na jednu osobu (koučovaného) je 3. To znamená, že pokud například 1 Dárce daruje 16.000 Kč má při splnění těchto Podmínek nárok na 8 koučinkových sezení, která ovšem musí být poskytnuta minimálně 3 a maximálně 8 osobám (koučovaným).

  4. Maximální hodnota daru, na kterou se tato Kampaň Koučink pro Loono vztahuje je 80.000 Kč. Pokud Dárce přispěje vyšší hodnotou, nezískává nárok na dodatečná sezení a zůstává mu nárok na 40 koučinkových sezení, jež mohou být poskytnuta min. 14 a max. 40 koučovaným.

  5. Jedno koučinkové sezení trvá 60 minut. Koučinková sezení budou poskytována v pracovní dny mezi 9:00-20:00 hod. dle aktuální dostupnosti Poskytovatele od 3.2. do 31.7.2021.

  6. Poskytovatel poskytne všechna sezení virtuálně (online) v českém či anglickém jazyce.

  7. Poskytovatel poskytne všechna sezení osobně, tzn. bude sám jediným koučem. Poskytovatel postupuje samostatně a Služby poskytuje vlastním jménem.

 

C. Práva a povinnosti Dárce a souhlas s uchováním osobních údajů

  1. Dárce se zavazuje k rezervaci termínu koučovacího sezení u Poskytovatele do 31.3.2021.  Sezení může být Poskytovatelem poskytnuto i po uplynutí této lhůty, a to do 31.7.2021 včetně. Rezervace všech termínů sezení ovšem musí být provedena do 31.3.2021. Po uplynutí této lhůty pro rezervaci Dárci nárok na poskytnutí Služby bez náhrady propadá. Rezervaci může u poskytovatele provést i koučovaný, pokud se liší od Dárce. Lhůta do 31.3.2021 ovšem musí být dodržena.

  2. Pokud se Dárce liší od koučovaného, zavazuje se Dárce k zajištění souhlasu koučovaného s těmito Podmínkami, jež se budou aplikovat analogicky, a předložení tohoto souhlasu Poskytovateli elektronickou formou v dostatečné době před zahájením koučinkového sezení.

  3. V případě nutnosti změny zarezervovaného termínu koučovacího sezení je Dárce povinen o tomto informovat Poskytovatele emailem anebo telefonicky nejpozději 48 hodin předem, jinak sezení bez náhrady propadá. Toto ustanovení se nevztahuje na situace vyšší moci.

  4. Dárce se zavazuje zajistit si podmínky pro řádný průběh přijetí poskytované Služby, zejména pak technické vybavení a stabilní internetové připojení.

  5. Dárce tímto dává výslovný souhlas s uchováním a zpracováním jeho osobních údajů, konkrétně jeho jména, emailové adresy, termínů a počtu koučinkových sezení, pro účely výkazu odkoučovaných hodin nutných pro mezinárodní certifikaci ICF. Tyto informace mohou být sdíleny s ICF a použity ICF k ověření toho, zda Poskytovatel skutečně Dárce koučoval. Pro účely ostatních certifikací či profesního vzdělávání Poskytovatele se toto ustanovení použije analogicky. Dárce souhlasí s uchováním jeho osobních údajů v souladu s tímto článkem Smlouvy po dobu 6 let.

  6. Dárce tímto prohlašuje, že veškeré úkony, jež podnikne v souvislosti anebo v přímé návaznosti na koučink jsou projevem jeho svobodné vůle, a proto za ně a jejich následky nese on, ne Poskytovatel, plnou zodpovědnost. Dárce také prohlašuje, že rozumí tomu, že koučink není psychoterapií a neslouží k léčbě psychických poruch. 

 

D. Práva a povinnosti Poskytovatele

  1. V případě nutnosti změny zarezervovaného termínu koučovacího sezení je Poskytovatel povinen o tomto informovat koučovaného na straně Dárce emailem anebo telefonicky nejpozději 48 hodin předem a nabídnout náhradní termín. Toto ustanovení se nevztahuje na situace vyšší moci.

  2. Poskytovatel se zavazuje poskytnout Službu Dárci poté, co si Dárce sám zarezervuje termín koučinkového sezení do 31.3.2021 a při splnění zde uvedených Podmínek.

 

E. Sdílení informací

  1. Veškerý obsah koučinkových sezení je považován za důvěrný mezi Poskytovatelem a Dárcem. Dárce má právo dle vlastního svobodného rozhodnutí sdílet tyto důvěrné informace s ostatními (např. zaměstnavatelem, rodinou, psychoterapeutem, mentorem apod.).

  2. Výše uvedená důvěrnost má smluvní, ne zákonný charakter.

  3. Poskytovatel je oprávněn využít způsobem, který zajišťuje anonymitu Dárce, obsah koučinkových sezení (zejména anonymní příběhy) pro účely svého dalšího vzdělávání, certifikace, školení, konference, odborné publikace a koučinkové praxe.

 

F. Závěrečná ustanovení

  1. Tyto Podmínky se řídí právním řádem České republiky. Jejich změna je možná pouze písemnými dodatky.

TERMS AND CONDITIONS FOR COACHING SERVICES 

PROVIDED WITHIN THE LOONO CAMPAIGN

 

These Terms and Conditions constitute a legally binding agreement made between the Donor and between Jana Honková, Business License No. 76517772, Výstavní 34, Brno 60300, Czech Republic, hereinafter “Coach”, concerning the Donor’s right to receive an online coaching session as a reward for the Donor’s donation to Loono, z.s., IČO 02905639, under these Terms and Conditions.

 

The Donor understands and agrees that by booking a coaching session via www.calendly.com, the Donor also agrees to be bound by these Terms and Conditions. Specific instructions and the booking link will be sent to the Donor by Loono after the donation is made and these Terms and Conditions fulfilled.

 

 

A. General Terms

  1. The Donor is any individual or a legal entity who donated a minimum of 2000 CZK to Loono, z.s., IČO 02905639, via www.donio.cz/loono and who also expressed the wish to receive a coaching session as a reward at the Donio platform by ticking the box “I want to receive a reward for my donation: online coaching” (in Czech: “Chci za svůj příspěvek odměnu: online koučink”) during the time of the Loono Campaign.

  2. The Coachee may be any individual participating in the coaching session which was given as a reward to the Donor. The Donor and the Coachee may or may not be the same individual.

  3. The Loono Campaign is a limited offer of a free coaching session(s) extended by the Coach to the Donor as a reward for their donation.  This coaching session(s) may be provided during as well as after the Loono Campaign; the offer and entitlement to the reward, however, may be only come into existence during the Loono Campaign.

  4. The duration of the Loono Campaign is 3 – 28 February 2021; the Coach retains the right to extend or shorten the duration of the Campaign unilaterally. The Loono Campaign shall be considered as finished and discontinued at the moment when the platform www.donio.cz/loono stops showing the option to receive the reward of an online coaching session in return for the donation.

 

B. Specific Terms, Responsibilities and Limit on Coaching Sessions per Coachee

  1. The Donor is entitled to 1 coaching session for every donated 2000 CZK provided all Terms and Conditions were met. While the Donor may be entitled to several coaching sessions, the maximum of 3 coaching sessions can be claimed by 1 Coachee. For example, if the Donor donated 16.000 CZK, they would be entitled to 8 coaching sessions; these 5 sessions may be used by the minimum of 3 and the maximum of 8 Coachees.

  2. The maximum donation for which these Terms and Conditions and the Loono Compaign apply is 80.000 CZK. Should the Donor donate more than 80.000 CZK, the entitlement would be no more than for 40 coaching sessions to be used by the minimum of 14 and the maximum of 40 Coachees.

  3. The Donor is obliged to book all coaching sessions by 31.3.2021 via www.calendly.com. The Coach will provide the sessions between 3.2. – 31.7.2021, however, all bookings must be made by 31.3.2021. By not booking a session by 31.3.2021 the Donor is giving up their claim to the reward. This booking may be done also by the Coachee, however the 31.3.2021 deadline must be kept.

  4. If the Donor differs from the Coachee, the Donor is obliged to secure the Coachee’s consent with these Terms and Conditions. The Donor will ensure that the Coach receives the Coachee’s consent with these Terms and Conditions well in advance of the coaching session. These Terms and Conditions will apply to the Coachee analogically and as appropriate.

  5. All coaching session(s) will be provided online in Czech or English.

  6. Every coaching session shall be for 60 minutes and will be provided during working days from 9AM to 8PM Central European Time depending on the availability of the Coach.

 

C. Session Cancellation Policy

  1. The Donor agrees to at least 48-hours advance notice to cancel or reschedule their coaching session. The Coach agrees to the same 48-hours notice shall the Coach need to cancel or reschedule the scheduled coaching session. This does not apply to vis major situations out of the control of the Donor or the Coach.

  2. If the Donor fails to submit the above-mentioned notice, the coaching session will be viewed as provided and consummated.

 

D. Coaching, the Coach-Donor Relationship and Other Responsibilities

  1. At all times during the performance of professional coaching services under these Terms and Conditions the Coach agrees to adhere to and abide by the ethical standards of behavior and conduct established by international standards for the coaching profession, particularly those of the International Coach Federation (“ICF”), including the ICF Code of Ethics which can be accessed by the Donor at www.coachingfederation.org.

  2. At all times during the rendering of professional coaching services by the Coach and receipt of the same by the Donor, the Donor shall be solely responsible for creating and implementing his or her own physical, mental and emotional well-being, decisions, choices, actions and results arising out of or resulting from the coaching relationship between the Coach and the Donor. The Donor each acknowledges and agrees that the Coach shall not be liable or responsible for any action or inaction, or for any direct or indirect result of the professional coaching services provided by the Coach.

  3. The Donor acknowledges that coaching is a comprehensive process that may involve different areas of the Donor’s life, including his or her work with the Employer, finances, health, relationships, education and recreation.  The Donor agrees that the decision as to how to handle or address these issues and the incorporation of coaching principles into those areas and the implementation of choices rests solely and exclusively with the Donor and not the Coach.

  4. The Donor acknowledges that coaching does not involve the diagnosis or treatment of mental disorders as defined by the American Psychiatric Association and that coaching is not to be used as a substitute for counseling, psychotherapy, psychoanalysis, mental health care, substance abuse treatment, or other professional advice by legal, medical or other qualified professionals and that it is the Donor’s exclusive responsibility to seek such independent professional guidance and advice as needed. 

 

E. Confidentiality

  1. All information, both oral and in writing, that the Donor shares with the Coach as part of the coaching relationship contemplated by these Terms and Conditions is bound by the principles of confidentiality as set forth in the ICF Code of Ethics.  The parties hereto recognize that the Coach-Donor relationship is not considered a legally confidential relationship (such as with one’s physician or attorney) and thus communications are not subject to the protection of any legally recognized privilege.

  2. The Coach agrees that they will not disclose any information pertaining to the Donor without the Donor’s written permission and except as would otherwise be permitted under the ICF Code of Ethics.   

  3. Confidential Information does not include information that 1) was in the Coach’s possession prior to being furnished by the Donor to the Coach; 2) is generally known to the public; 3) is obtained by the Coach from a third party (not the Donor), without a breach of any obligation to the Donor; 4) is independently developed by the Coach without the use or reference to the Donor’s confidential information; 5) the Coach is required by law, statute, lawfully issued subpoena, or by court order to disclose; 6) is disclosed to the Coach by the Donor and as a result of such disclosure the Coach reasonably believes there to be an imminent or likely risk of danger or harm to the Donor or others; and 7) involves illegal or criminal activity.

 

F. Release of Information

  1. The parties to these Terms and Conditions acknowledge and agree that the Coach is or may be engaged in training and continuing education pursuing and/or maintaining ICF and other credentials.  That process requires the names and contact information of all Coach Donors for verification by the ICF. 

  2. By signing these Terms and Conditions, the Donor consents to the disclosure by the Coach of only the Donor name, email address and start and end dates of the coaching services to the ICF only for purposes of verifying the coaching relationship. No personal notes or other personal information will be shared.

 

G. Record Retention

  1. The Donor understands and agrees that the Coach will maintain, store and dispose of any documents, information and data acquired or shared during the term of the Coach-Donor relationship in a manner that promotes confidentiality, security and privacy and complies with all applicable laws, agreements and regulations. Such records will be maintained by the Coach in print or digital format for a period of not less than 6 years.

H. Limited Liability

  1. Except as expressly provided in these Terms and Conditions, the Coach makes no guarantees, representations or warranties of any kind or nature, express or implied with respect to the coaching services negotiated, agreed upon and rendered. In no event shall the Coach be liable to the Donor for any indirect, consequential or special damages.  Notwithstanding any damages that the Donor may incur, the Coach’s entire liability under these Terms and Conditions, and the Donors’ exclusive remedy shall be limited to the amount actually paid by the Donor to the Coach under these Terms and Conditions for all coaching services rendered through and including the termination date.

 

I. Applicable Law

  1. These Terms and Conditions shall be governed and construed in accordance with the laws of the territory of Czech Republic, without giving effect to any conflicts of law’s provisions.

  2. These Terms and Conditions may be amended, altered or supplemented only in writing.

  3. In disputes, the Czech version of the Terms and Conditions published on www.janahonkova.com/better-world shall be considered as decisive.
